Fan Flaire - Digital Millennium Copyright Act (DMCA) Policy

 

Fan Flaire Adult respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We also accommodate and do not interfere with standard technical measures used by copyright owners to protect their materials.

 

 

Reporting Claims of Copyright Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

  1. Identification of the copyrighted work that you claim has been infringed.
  2. Identification of the material that you claim is infringing and where it is located on the site (please include a specific URL or URLs).
  3. Your address, telephone number, and email address.
  4. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your electronic or physical signature.

Counter-Notification

If you believe that your material that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to the Copyright Agent:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal court in your jurisdiction, and that you will accept service of process from the person who provided the original notification of the alleged infringement.
  5. Your physical or electronic signature.

If a counter-notice is received by the Copyright Agent, Fan Flaire may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the infringing party, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the counter-notice.
